Welcome to American Pressure Systems! The terms "we", "us" and "our" refer to Powerhouse Supply South LLC, doing business as American Pressure Systems. American Pressure Systems operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). American Pressure Systems is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

When you place an order, you are making an offer to purchase. American Pressure Systems reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until American Pressure Systems confirms acceptance, and we must receive and process your payment before we accept it. Please review your order carefully before submitting it, as we may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, change or cancel an order, we will attempt to notify you using the email address, billing address and/or phone number provided with the order.

Your purchases may be returned or exchanged only in accordance with our Shipping & Returns Policy.

You represent and warrant that your purchases are for your own personal, household or business use, and not for resale or export, unless we have agreed otherwise in writing.

4. Prices and Billing

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect when the order is placed, as shown in your order confirmation email. Unless expressly stated otherwise, posted prices do not include taxes, shipping, handling, customs or import charges.

Prices in our online store may differ from prices offered in our physical stores or in online or other stores operated by third parties. From time to time we may offer promotions that affect pricing and are governed by their own terms and conditions. If the terms of a promotion conflict with these Terms, the promotion terms govern.

You agree to promptly update your account and other information, including your email address and payment card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment card information you provide is true, correct and complete, (ii) you are authorized to use that payment card for the purchase, (iii) your card issuer will honor the charges you incur, and (iv) you will pay the charges you incur at the posted prices, including shipping and handling charges and any applicable taxes.

5. Shipping and Delivery

All delivery times are estimates only and are not guaranteed. We are not liable for shipping and delivery delays, including delays caused by shipping carriers, customs processing or events outside our control. 6. Intellectual Property

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement of them, are owned by American Pressure Systems, its affiliates or its licensors, and are protected by U.S. and foreign patent, copyright and other intellectual property laws.

You must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are trademarks of their respective owners. American Pressure Systems is not affiliated with any manufacturer unless expressly stated.

7. Optional Tools

We may give you access to customer tools offered by third parties as part of the Services, such as financing applications. We do not monitor, control or have any input into these tools.

You acknowledge and agree that we provide access to these tools "as is" and "as available", without any warranties, representations or conditions of any kind and without any endorsement. We have no liability whatsoever arising from or relating to your use of optional third-party tools.

You use any optional tools offered through the site entirely at your own risk and discretion. You should make sure you are familiar with, and approve of, the terms under which the relevant third-party provider(s) offer those tools.

9. Relationship with Shopify

American Pressure Systems is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with American Pressure Systems. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and American Pressure Systems, including any injury, damage or loss resulting from products and services you purchase. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with American Pressure Systems.

We may terminate these Terms or your access to the Services (or any part of them) at any time, in our sole discretion and without notice. You will remain liable for all amounts due up to and including the date of termination.

The following sections survive any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

Many products we sell are covered by their manufacturer's warranty. Those warranties are provided by the manufacturer, not by American Pressure Systems, and their terms are set by the manufacturer. Contact us for help with a warranty claim.

18. Indemnification

You agree to indemnify, defend and hold harmless American Pressure Systems, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

We will notify you of any indemnifiable claim, but a failure to notify you promptly will not relieve you of your obligations unless you are materially prejudiced by it. That determination will not affect the validity and enforceability of any other remaining provisions.
